
Owner and Tenant Leases and Access to Pool & Clubhouse
Dear Villas of Somerset Owners and Tenants,
As per the rules stated in the governing documents of the association, all owners/tenants must provide a copy of any lease between owner and tenants within (10) days of the unit being occupied by any tenant. Also, it is mandatory that the association has the correct and valid contact information for any tenant who occupies a unit. The association needs to have the information of the tenants such as Names, Contact phone numbers, and email addresses to send important communications regarding the community. Please upload the leases and update the tenant's contact information in the community portal or email Vilsomec@ciramail.com with a copy of the executed lease and tenant contact information.
The association is implementing some changes such as installing locks on the pool, clubhouse, and fitness center. Each owner/resident will be provided with an individual passcode to gain access to the amenities. The locks will be arriving this week and will be activated on September 21, 2023. Management will be reaching out to each owner with their unique code for entry. Also, it is important to know that for any association dues that are past due, the Board of Directors and Management will deactivate the code for use of the amenities as per Florida statutes 718.303 An association may suspend, for a reasonable period of time, the right of a unit owner, or a unit owner’s tenant, guest, or invitee, to use the common elements, common facilities, or any other association property for failure to comply with any provision of the declaration, the association bylaws, or reasonable rules of the association. This paragraph does not apply to limited common elements intended to be used only by that unit, common elements needed to access the unit, utility services provided to the unit, parking spaces, or elevators.
In the near future the association will be issuing parking passes to be placed in the windshields of each car that will be parked overnight on the association property. If you rent out the unit for vacation rentals, the association will provide you with a pass that you can print or utilize to send to your guests. There will be more communication regarding this to come in the near future. All Vehicles that receive such permanent passes must be registered with the association.
All of the terms and provisions of the Condominium Documents and these Condominium Rules and Regulations pertaining to use and occupancy shall be applicable and enforceable against any person occupying a Unit as a tenant to the same extent against a Unit Owner. Any lease or rental agreement, whether oral or written and whether specifically expressed in such agreement or not, shall be deemed to contain a covenant upon the part of each such tenant designating the Association as the Unit Owner’s agent for the purpose of and with the authority to terminate any such lease or rental agreement in the event of violations by the tenant of the terms and provisions of the Condominium Documents or Condominium Rules and Regulations. Such leasing or rental agreements must set forth an acknowledgment and consent on the part of the lessee-sub lessee tenant to use, occupy, and possess such Unit in conformance and compliance with the provisions of these Condominium Rules and Regulations, as well as the Condominium Documents. In the event a Unit Owner fails to secure a written leasing rental agreement, and does not provide a copy to the Association, the Association shall have the right to request the lessee-sub lessee-tenant to execute an acknowledgement to use and occupy the rental or leased Unit in conformance with the Condominium Documents and the Rules and Regulations. All leases are to be filed to the Board of Directors.
